Acceptance of Terms
This website portal ("Portal") operated by BRIGHTSTAR LOTTERY (herein "we" or "us") for use by the Retailer Management Insights application ("RMI") mbmer lotteries. These Terms of Use, along with any additional terms and conditions that are referenced herein or that are presented elsewhere on the Portal, including the Privacy Notice and any terms in relation to a specific service or feature on the Portal (collectively, "Terms of Use"), set forth the terms and conditions that apply to your use of the Portal. By using the Portal, you accept and agree to comply with all of the terms and conditions hereof. If you do not agree to these Terms of Use, you should not access or use the Portal.
Only authorized employees of BRIGHTSTAR LOTTERY PLC and the RMI participating lotteries are permitted to access and obtain RMI-based reports, data and other information relevant to the optimization and expansion of lottery retail accounts by or through the Portal (as determined by the RMI Advisory Board) ("Purpose"), and/or otherwise participate in the Portal's activities and offerings. Information collected by us through the Portal is subject to the Privacy Notice posted on the Portal and incorporated herein by reference. By interacting through the Portal, you agree and consent to conduct the transactions available through the Portal and to communicate with us regarding all such matters by electronic and other means contemplated herein.
We can change or update these Terms of Use at any time with prior approval from the RMI Advisory Board without notification and such changes or updates will be effective immediately upon posting. If you continue to use this Portal after such changes or updates are posted, you will be deemed to agree to such changes or updates. Unless otherwise indicated, any new products, features, information or services added to the Portal will also be subject to these Terms of Use. Please review the Portal and these Terms of Use periodically for changes and updates.

Limited License and Site Access; All Rights Reserved
Subject to compliance with these Terms of Use, we hereby grant you a limited, non-exclusive and revocable license to access and make use of the Portal and RMI-based data available through the Portal solely for the Purpose and solely in connection with the internal business purposes of the RMI participating lottery by which you are employed.
You may not use, disclose, distribute, copy, sell, resell, visit, or otherwise exploit for any commercial purpose the Portal or any portion of the Portal or RMI-based information. You may not alter, modify or tamper with the Portal or in any manner whatsoever circumvent
our procedures regarding access to or use of the Portal, or attempt to do any of the foregoing. You agree to maintain the confidentiality of account passwords and accept full responsibility for all activities conducted and all information provided through the Portal account.
We reserve all rights not expressly granted for ourselves and on behalf of our licensors.
Copyright
The Portal is copyrighted by us and/or our third-party suppliers.
You may download information from the Portal and print out a hard copy for internal business purposes provided that you keep intact and do not remove or alter any copyright or other proprietary notice contained in the RMI analysis.
Trademarks and Service Marks
Certain trademarks, including "BRIGHTSTAR LOTTERY" and "RMI", are the service marks and trademarks of BRIGHTSTAR LOTTERY or one of its affiliates. The domain name for the Portal, all page headers, custom graphics, and button icons are service marks, trademarks, logos, and/or trade dress of International Game Technology PLC. All other trademarks, service marks, trade dress, product and service names, company names or logos, whether registered or not, on the Portal are the property of their respective owners, whether BRIGHTSTAR LOTTERY or one of its suppliers. In addition to complying with all applicable laws, you agree that you will not use any such trademarks, service marks, trade dress, or other logos from the Portal without the prior written authorization of their owners.
Ownership of information submitted via this Site
With the exception of any personal information you submit (which will be maintained in accordance with our Privacy Notice), any information you transmit to us via this Site, whether by direct entry, submission, email or otherwise, including data, questions, comments, feedback or suggestions, will be treated as non-confidential and non-proprietary and will become the property of BRIGHTSTAR LOTTERY. Such information may be used for any and all commercial and noncommercial purposes, including, without limitation, reproduction, solicitations, disclosure, transmission, publication, broadcast, and posting, without any obligation to you, whether financial, attribution or otherwise.
By sending us your communications via the Portal or by any other means you are giving us permission to use any ideas, concepts, know-how, or techniques contained in those communications (including, without limitation, games and game ideas) without notice or obligation to you. When you submit any material or information subject to protection under intellectual property laws (e.g., photos, videos, articles, etc.) to the Portal, you represent,
warrant and covenant to us that you have the necessary rights to copy and display such information. Governing Law; Jurisdiction; Venue; Severability of Provisions
Any claim or dispute arising out of or relating to any RMI-based information, these Terms of Use, or any of them is subject to the exclusive jurisdiction of the Superior Court of Providence County, Providence, Rhode Island, and you hereby consent and submit to the personal jurisdiction of such court and waive any objections thereto.
Password Accounts, Passwords, and Security
You are entirely responsible for maintaining the confidentiality of your password and account and for any and all activities that occur under your account regardless of whether you authorized such access or use. You agree to (a) immediately notify us of any unauthorized use of your account or any other breach of security of which you become aware, and (b) exit completely from your account at the end of each online session. You may not use anyone else's account at any time.
Remedies
Without limiting any other provision set forth in these Terms of Use, you agree that any violation, or threatened violation, by you of these Terms constitutes an unlawful and unfair business practice that will cause us irreparable and unquantifiable harm. You also agree that monetary damages would be inadequate for such harm and consent to our obtaining any injunctive or equitable relief that we deem necessary or appropriate. These remedies are in addition to any other remedies we may have at law or in equity.

Retail Market Insights Portal Privacy Notice Thank you for visiting the Retail Market Insights Portal, a website portal ("Portal") operated by or on behalf of BRIGHTSTAR LOTTERY (herein "we" or "our" or "us"). This Portal is intended and authorized for use and access by authorized lottery jurisdictions who are participating in the Retail Market Insights "RMI" project only. This Privacy Notice ("Notice") explains the online information practices of BRIGHTSTAR LOTTERY and sets out what information we collect through the Portal, how we collect it, and what we do with it. Please contact us as indicated in the "Contact Us" section below if you have any questions or would like additional information.
Lottery Sales Information
We collect non identifiable lottery retailer sales information directly from state lotteries participating in the RMI project for the sole purpose of documenting, analyzing and learning insights for the benefit of each participating lottery. Only authorized jurisdictions who have agreed to participate in the RMI programs are able to access lottery reports and analysis. Portal usage, measurement, analytics and other data and information available to us directly in aggregated or other non-identifiable forms or formats are outside the scope of this Notice and not subject to the collection or usage restrictions set forth herein.
Data Management and Enrichment
The lottery sales data collected from each participating jurisdiction is cleansed and normalized in order to ensure accuracy, analysis and presentation in a usable form.
Third-party information is added to enrich the collected sales data to provide more in-depth insights relative to performance trends and characteristics between retailers and trade types. Additional information consist and may not be limited to demographic data and store information (number of checkout lanes, number of employees, square footage, etc.).
Use of Jurisdiction's Information
Each participating lottery will utilize RMI-based data solely for the purpose of obtaining retail market insights and will not share this information with any non-participating RMI jurisdiction.
Only macro-level, aggregated, non-identifiable RMI data is shared with all participating jurisdictions. By way of example, the California Lottery would receive aggregated data from all 7-Eleven sales across all participating jurisdictions.
Jurisdictional, retailer-specific, identifiable competitive and confidential information will only be made available to the lottery jurisdiction in which such retailer or retailer chain has stores. By way of example, this would include store-level retailer sales information for a particular 7-Eleven store in California. This information would only be made available to the California Lottery. The California Lottery would not be authorized to share such store level information with any other retailer and would only be authorized to share such information with the particular retailer or chain's corporate management.
Comments and Feedback
We appreciate your questions, comments and feedback ("Feedback") about us, the Portal and lottery retail sales analysis available through the Portal and welcome your messages at the space provided on the Portal. We will share your Feedback with the RMI Advisory Board which has been established to review RMI's usage, user feedback and suggestions for enhancement. We may archive your Feedback for a certain period of time or discard it once it is no longer needed
Use of Tools, "Cookies"
This Portal may use "cookies". A cookie is a small text file composed of letters and numbers that is stored on your computing device. Cookies allow us to identify your computer, but not you personally. This means we may use information we hold and cookies to identify your individual Portal search behavior, location and preferences. This will enable us to improve the RMI Portal functionality and send you as needed personalized and relevant communications.
Your computer devices also may allow you to disable cookies and similar web artifacts by setting your bowser preferences at any time; however, this portal may require the use of session cookies to establish the connection between your device and the Portal.
Monitoring
To ensure that we carry out your instructions accurately, improve our Portal services, provide security and enable compliance with applicable laws, rules, regulations, policies and procedures, we may monitor and/or record: (1) telephone calls; and (2) interactions, transactions and activities on this Portal.
